           Nineteenth Legislature of the State of Hawaii, Regular Session of
           1997, that this body requests the Governor to convene a Task Force
           to conduct a comprehensive review of the scope, implementation,
           efficiency, and effectiveness of Title 7, HRS, and to seek consensus
           on necessary or appropriate changes; and
           representation of the following on the Task Force:
                     Collective Bargaining, the Department of Human Resources
                     Development, and the 4 counties; and
                     bargaining unit representatives; and
          such other persons on the Task Force as in the Governor's opinion,
          after consultation with representatives of public employers and
          public employees, are necessary or advisable to ensure a broad,
          comprehensive, and balanced consideration of Title 7, such as
          sector, academia, and the general public; and
          not be limited to:
                     the State and counties and maintaining the requirement
                     that these jurisdictions act in concert and decide by
                     majority vote matters pertaining to wages, hours, and
                     conditions of employment;
                     precedential language of various chapters in Title 7, in
                     particular, the relationship of the section to other
                     statutes and to the legislative prerogative;
                     operation of state government, management flexibility in
                     the conduct of public employer operations, and the role of
                     seniority and the merit principle in the civil service
                     system as mandated by Article XVI of the Hawaii State
                     Constitution;
                     chapter 89,  with a detailed examination of what
                     constitutes a negotiable issue;
                     excluded from, and included in, collective bargaining
                     units, and the impact on the declaration of essential
                     positions during legal strikes;
                     labor management disputes under the provisions of chapter
                     89;
                     cited above on the implementation of Title 7 and on other
                     related statutes and the options available to provide
                     clear public policy decisions; and
          Task Force is requested at all times to operate in good faith and
          with the goal of reaching consensus and, where consensus is not
          possible, to identify the competing viewpoints and goals and
          associated proposals so that the Legislature may be fully advised of
          status report to the Legislature no later than twenty days prior to
          the convening of the Regular Session of 1998; and a final report
          inclusive of findings and recommendations to the Legislature no later
          than twenty days prior to the convening of the Regular Session of

           Nineteenth Legislature of the State of Hawaii, Regular Session of
           1997, that the Office of Planning of the Department of Business,
           Economic Development, and Tourism is requested to immediately
           facilitate discussions among all interested parties with respect to
           the issues arising out of and related collectively to PASH; and
           interested parties are strongly encouraged at all times to operate
           in good faith and with the goal of reaching consensus and, where
           consensus is not possible, to identify the competing viewpoints and
           goals and associated proposals so that the Legislature may be fully
           informed and advised of the full range of policy options available;
           and
           consultation with the Department of Land and Natural Resources, is
           resource and not as an advocate for any position, and is further
           requested to seek the services of professional neutral facilitators
           such as the Judiciary Center for Alternate Dispute Resolution if
           beneficial to achieving the goals of this Resolution; and
           requested to provide a brief written progress status report to the
           Legislature, via the respective Chairs of the House Committee on
           Hawaiian Affairs and Senate Committee on Water, Land and Hawaiian
           Affairs, and to all other interested parties who request a report,
           on a monthly basis through and including November 1997; and
           requested to submit a final report to the Legislature twenty days
           with specificity the process undertaken, the areas of consensus,
           and, with respect to the remaining issues, the policy options for

TITLE     RELATING TO HAWAIIAN MEDIUM SCHOOLS ON KAUAI AND HAWAII.

DESCRIPT        BE IT RESOLVED by the House of Representatives of the
           Nineteenth Legislature of the State of Hawaii, Regular Session of
           1997, that the Department of Education is requested to:
                     medium of the standard Hawaiian language for Hawaiian
                     K - 12 schools at:  Ke Kula Niihau o Kekaha School, Kauai;
                     Ke Kula o Nawahiokalaniopuu at Keaau, Hawaii; Ke Kula
                     Kaiapuni Hawaii o Kona at Kealakehe Elementary School,
                     Hawaii; Ke Kula Kaiapuni Hawaii o Waimea at Waimea
                     Elementary and Intermediate School, Hawaii;
                     accomplish the mandates of this Resolution, provided that
                     such funds shall be used in addition to federal and other
                     funds to specifically provide transportation services,
                     curriculum development and dissemination, equipment and
                     supplies, repair and maintenance, and salaries and
                     professional development for teachers, staff and
                     is made available to all other Hawaiian language immersion
                     schools;
                     educated exclusively in 1 of the State's 2 official
                     languages;
                     Hawaiian language medium schools through contracts with
                     the Office of Hawaiian Affairs; and
                     Hawaiian within the home and the community, with standard
                     Hawaiian as the instructional medium in the schools; and
          Resolution, declines to comply with these requests, the Department of
          Education is requested to submit a report to the Legislature no later
          than twenty days prior to the convening of the Regular Session of
          1998, detailing its analysis and reasons as well as specific
          proposals, for further legislation to accomplish the purposes of this
