Allows state agencies to agree in writing to an indemnity provision by which the State agrees to indemnify, defend, and hold harmless a US agency, its officers, agents, and employees in order to receive federal aid, assistance, support, benefits, services, and interests in or rights to use federal property. INTRODCR Souki J (BR) (586-6100) DESCRIPT Requires a contractor to secure and the purchasing agency to receive a tax clearance to the effect that all tax returns have been filed and all taxes, interest, and penalties levied have been paid, before a contract is binding or effective. Allows the director of taxation or the Internal Revenue Service to waive this requirement. Requires the comptroller or respective county director of finance, upon the request of the director of taxation, to set off the amount of the tax debt against any payment due to the contractor until the tax debt is paid in full. Provides criteria. -- Establishes a provision relating to preferences to bidders which requires that the amount bid or price proposed for a construction contract by a bidder or offerer who has filed State tax returns and paid all State taxes owed be reduced for bid or proposal evaluation purposes. Provides criteria. -- Allows the director of taxation to waive the Internal Revenue Service tax clearance requirement. Establishes guidelines for the withholding of final payment of a contract until the receipt of tax clearances from the director of taxation and the Internal Revenue Service. -- Changes the name of the procurement policy office to procurement policy board. -- Amends the provision relating to the chief procurement officers for state entities. Provides criteria. -- Allows contracts for professional services of less than 25,000 dollars to be negotiated with qualified persons. -- Amends provision relating to small purchases; prohibition against parceling to prohibit parceling of procurements of less than 25,000 dollars for goods, services, or construction. -- Requires the chief procurement officer to keep a record of all procurements for goods, services, or construction of 25,000 dollars or more. -- Amends provision relating to governmental relations and cooperative purchasing to add the definitions of external procurement unit and nonprofit private procurement unit, and amends the definition of cooperative purchasing to include same. -- Allows cooperative purchasing agreements to be exempt from preferences provision. -- Amends provision relating to Hawaii products to require that all invitations for bids and requests for proposals include a description of the products that are listed in the Hawaii products list and their established classes. Requires all persons submitting proposals claiming a Hawaii products preference to designate the product's price. Where a bid or proposal contains both Hawaii and non Hawaii products, the price bid or offered for the Hawaii product shall be reduced for contract evaluation purposes.
