MEASURE SB0005 SD2 HD1 CD1 (CCR 77) TITLE RELATING TO MOTORSPORTS INSURANCE. INTRODCR Iwase R (586-6740) DESCRIPT Establishes provision relating to waiver of liability in a motorsports event to exclude the areas intended for use by spectators or non participants from the definition of motorsports facility, and spectator from the definition of participant. Provides that a participant is a person 18 years of age or older who is required to sign a waiver and release, waiver of liability, or indemnity agreement. Adds definitions of motorsports facility, owner, and participant. Requires that signing of a waiver and release, waiver of liability, or indemnity agreement by a participant and a witness in any motorsports racing event shall be construed as an express assumption of risk. Provides exception to waiver when acts or omissions constitute gross negligence, wilful and wanton conduct, or intentional acts on the part of another participant or employees or agents of the motorsports facility.
