INTRODCR Menor R (586-6150) DESCRIPT Establishes provisions for personal injury protection benefits with respect to accidental harm with an aggregate limit of 10,000 dollars. Includes chiropractic care. -- Establishes a covered loss deductible which provides that whenever a person effects a recovery for bodily, injury, whether by suit, arbitration, or settlement, and it is determined that the person is entitled to recover damages, the judgment, settlement, or award shall be reduced by 5,000 dollars to the amount of personal injury protection benefits incurred, whichever is greater, up to the maximum limit. -- Allows the insurance commissioner to annually adjust rates prospectively for any class or type of mandatory coverage or optional additional motor vehicle insurance coverage, if rates are excessive, inadequate, or unfairly discriminatory. -- Establishes provisions for managed care option; preferred repair provider program; original equipment manufacturer's and like kind and quality parts; plain language billings; fraud violations; group insurance plans; u drive insurance policy, primary; and insurance fraud investigation unit. -- Enables the insurance division to employ or retain an attorney. -- Changes no fault motor vehicle insurance to motor vehicle insurance. -- Sets maximum limit of the total personal injury protection benefits payable per person to 10,000 dollars. -- Sets liability coverage at 20,000 dollars per person, with an aggregate limit of 40,000 per accident. Allows option to purchase wage loss benefits and to purchase death benefits. -- Amends tort liability provisions to include cases where personal injury protection benefits are equal to or exceeding 5,000 dollars and to include the cause of death or injury to another person while driving under the influence of intoxicating liquor or drugs. -- Repeals medical rehabilitative limit, permissible charges and peer review. -- Requires the commissioner to do all things necessary to implement the act and with the assistance of the legislative reference bureau to review all existing state laws relating to motor vehicle insurance and financial responsibility and to submit legislation to amend or repeal inconsistent laws. Report to the legislature. -- Requires motor vehicle insurers to implement 20 to 35 per cent reduction on premiums for insureds who have policies with only mandatory minimum coverages and adjust premiums paid by insureds whose policies contain more than the mandatory minimum coverage. -- Transfers employees of the insurance division's compliance unit to the insurance fraud investigations unit. -- Establishes a motor vehicle insurance benefits task force attached to the insurance division to review motor vehicle insurance system and devlop a comprehensive plan for reducing costs; paying for the cost of motor vehicle insurance or benefits; maximizing coverage and benefits for residents; and alleviating the problem of uninsured motorists. Provides that social records shall be kept confidential. Permits the disclosure of legal proceedings of juvenile offenders aged 16 years or older who are taken into custody for an act that, if committed by an adult, would be murder in the 1st or 2nd degree or attempted murder in the 1st degree, result in serious bodily injury to a victim, be a class A, B, or C felony and the minor has more than 1 prior adjudication for acts which would constitute felonies. Requires persons convicted of a criminal offense against a minor or of a sexually violent offense to register for life with the attorney general. Provides for access to registration information by law enforcement agencies and government agencies; and for release of relevant information to the public. Provides criteria. Establishes duties upon discharge, parole, or release of sex offender. Provides for periodic verification of registration information, and requires sex offender to register change of address, which shall be reported by the attorney general to county police and the Federal Bureau of Investigation. Establishes good faith immunity for law enforcement agencies and their employees, and state and county officials. Class C penalty for failure to comply with registration requirements. -- Requires DNA testing of committed persons convicted of sex crimes against minors, including the promotion of child abuse in the 2nd degree. Provides that the person commits the offense if the person drives, operates, or assumes control of any vehicle with a measurable amount of alcohol concentration, where tests provide a result equal to or greater than 2/100 or less than 8/100 grams of alcohol per 100 milliliters or cubic centimeters of blood or equal to or greater than 2/100 or less than 8/100 grams of alcohol per 210 liters of breath. Amends definition of a matching payment period for a general election to be from January 1 of the year of a general election through the day of the general election. -- Requires the campaign commission to adopt advisory opinions as policy guidance on interpretation of the statute and rules. -- Requires candidates and candidate committees to file an organizational report within 10 days of receiving any contribution or making any expenditures, the aggregate amount of which is more than 1,000 dollars. Requires each candidate to re register for the new election period. -- Requires all monetary contributions to be deposited in depository institutions. Provides criteria. -- Prohibits candidates and candidate committees from accepting other loans or contributions if any loan in excess of 100 dollars is not repaid within 5 years, until such loan is repaid in full. Prohibits noncandidate committees from accepting loans. -- Requires preliminary reports by noncandidate committees. -- Provides that candidates, parties, or committees whose aggregate contributions or expenditures total 1,000 dollars or less only need to file a final election period report. -- Specifies contents of noncandidate committee final primary reports. -- Allows a candidate, party, or committee to terminate registration with the commission if there is no surplus or deficit. -- Exempts elected officials who complete their term who file to become a candidate for reelection within 4 years after the end of the term from which they resigned. -- Amends provision relating to the Hawaii election campaign fund to provide that no more than 100,000 dollars may be appropriated annually for the administration of the program. -- Amends provisions relating to the maximum amount of qualifying contributions available to candidates for state and county offices.
